Do-Not-Call Registry Update

The 10th Circuit Court of Appeals stayed the Colorado District Court's injunction against the Federal Trade Commission (FTC) regarding the National Do-Not-Call Registry pending appeal. The court also expedited the briefing schedule, with an oral argument by the FTC to be held on November 10.

In the coming months, the court will consider whether the do-not-call list is unconstitutional. Outside counsel advises that given the high public interest in the case, the expedited briefing schedule and the First Amendment issues at stake, we should expect a decision from the court of appeals by the end of the year. However, until that time, the do-not-call list will be implemented and enforced by the FTC and Federal Communications Commission.
